Under IDEA, your family
has protected rights

The Individuals with Disabilities Education Act (IDEA) gives parents specific rights when it comes to educational evaluations. You don't have to accept the school's assessment as the final word.

La Ley IDEA le otorga derechos específicos como padre en cuanto a las evaluaciones educativas de su hijo.

01

Right to Disagree

If you disagree with the school's evaluation, you have the right to request an IEE in writing.

02

Public Expense

The school district may be required to fund your IEE if they cannot justify their own evaluation.

03

Must Be Considered

The school must consider the IEE results when making decisions about your child's services.

04

IEP Meetings

You can bring your IEE evaluator to IEP meetings to present findings and advocate for your child.

How to Request an IEE from Your School District

1

Put it in writing. Send a letter or email to your special education director stating you disagree and are requesting an IEE.

2

Request their IEE criteria. The district must provide you with criteria for approved IEE evaluators.

3

Contact Lumina. We'll confirm we meet the district's criteria and schedule your child's evaluation.

4

Attend the IEP meeting. We present our findings and advocate alongside your family.

Frequently asked questions

How much does an IEE cost? / ¿Cuánto cuesta una IEE? +
Our evaluation fees vary depending on the scope of assessment needed. We offer a free consultation to discuss your child's needs and provide a detailed quote. If your school district is funding the IEE, they are responsible for the cost within reasonable market rates.
Can the school refuse to pay for an IEE? +
Yes — the school district may initiate a due process hearing to defend their evaluation. However, if they do not file for due process, they must fund your IEE. We can help you understand this process and your options.
How long does the evaluation take? +
Most evaluations are completed across 1–2 sessions, typically 2–3 hours total. The full written report is usually ready within 2–3 weeks of completing testing.
Do you conduct evaluations in Spanish? / ¿Hacen evaluaciones en español? +
Yes! We offer fully bilingual evaluations in English and Spanish. This is especially important for children who speak Spanish at home, as it ensures we accurately distinguish between a language difference and a true language disorder.
Will you attend our IEP meeting? +
Absolutely. We strongly encourage IEP meeting attendance. Having your evaluator present to explain findings and advocate for recommended services can make a significant difference in the outcome of your child's IEP.
What areas of Texas do you serve? +
We serve families throughout Texas. Some portions of evaluations can be conducted via telehealth, and we travel for in-person sessions. Contact us to discuss your location and we will find a solution that works for your family.
